FITNESS OUTCOMES x ALIDA BALLESTRO PROMOTION
TERMS AND CONDITIONS
1. Promoter
The promoter is Patties Foods Pty Ltd (ABN 62 007 157 182) trading as Fitness Outcomes of Level 2, 1 Joseph Avenue, Mentone, VIC 3194, Australia ("Promoter").
2. Acceptance of Terms
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions, and entrants accept and acknowledge full responsibility for their decision to participate in the promotion and to take the Prize if they are the winner.
3. Eligibility
Entry is open to Australian residents aged 18 years and over.
Employees of the Promoter and its related bodies corporate, and their immediate families, and agencies associated with this promotion, are ineligible to enter.
4. Promotion Period
The promotion commences at 10:00Am AEST on 12 September 2026 and closes at 11:59pm AEST on 20 September 2026 ("Promotional Period").
5. How to Enter
To enter, an eligible entrant must, during the Promotional Period:
a) locate the designated promotional post published on the @alidaballestro Instagram account; and
b) comment on the designated promotional post by stating what “fuels your goals” and tagging a friend, in accordance with the instructions contained in that post.
Each eligible comment submitted in accordance with these Terms and Conditions will constitute one (1) entry. Entry is limited to one (1) entry per person. The Promoter may remove or disqualify any entry containing offensive, defamatory, inappropriate or unlawful content.
6. Draw
The winner will be selected by random draw from all valid entries received during the Promotional Period. The draw will take place at 10:00am AEST on 21 September 2026 at Mike Da Silva & Associates (Aust) P/L, Level 16, 1 Denison Street, North Sydney NSW 2060 (MDSA). The first eligible entry randomly drawn will win the prize.
7. Prize
There will be one (1) winner. The winner will receive one (1) entry to the 2026 Nike Melbourne Marathon, to be held on Sunday 11 October 2026, valued at AUD$235 (including GST). The total prize pool is AUD$235 (including GST). The prize is subject to the terms and conditions, conditions of entry and any other requirements imposed by the Nike Melbourne Marathon and/or the relevant event organiser.
The prize:
a) is not transferable or exchangeable;
b) cannot be redeemed for cash;
c) does not include any costs not expressly stated, including travel, accommodation, meals, insurance or any incidental expenses; and
d) must be used in accordance with the requirements of the relevant event organiser.
The winner must declare to the Promoter and/or any prize supplier any health-related issues that may affect their safe participation in any part of the Promotion or Prize (where applicable) and obtain a written clearance from their doctor in this respect. The Promoter (upon consultation with any relevant qualified person) reserves the right to refuse to allow a winner to take part in an aspect of a Prize, if the Promoter determines, that a winner is not in the mental or physical condition necessary to be able to safely participate in that aspect Prize.
In order to participate in this Promotion and/or the activities which may be awarded as part of the Prize, the winner must comply with applicable height, weight, health, fitness, skill, balance, dexterity and any other requirements normally associated with the particular activity.
It is the entrant’s responsibility to ensure that they are sufficiently healthy and fit so as to safely participate in this Promotion, any challenge and/or undertake the activities awarded as part of the Prize.
8. Winner Notification
The winner will be notified via Instagram direct message from the @fitnessoutcomes Instagram account within two (2) business days of the draw.
The Promoter will publish the winner's first name and social media handle on the Promoter's and/or Alida Ballestro's relevant social media account from 24 September 2026, for a minimum of 30 days.
9. Claiming the Prize
The winner must respond to the Promoter's notification and provide any information reasonably required to facilitate the prize by 12:00pm AEST on 24 September 2026.
If the winner does not claim the prize by the required deadline, is unable to be contacted or is deemed ineligible, the prize will be deemed unclaimed and clause 10 will apply.
10. Unclaimed Prize Draw
If the prize remains unclaimed by 12:00pm AEST on 24 September 2026, or if the winner is unable to be contacted or is deemed ineligible, the Promoter will conduct an unclaimed prize draw from all remaining valid entries received during the Promotional Period.
The unclaimed prize draw will take place at 12:00pm AEST on 25 September 2026 at MDSA, Level 16, 1 Denison Street, North Sydney NSW 2060.
The first eligible entry randomly drawn will win the unclaimed prize.
The winner of the unclaimed prize draw will be notified via Instagram direct message from the @fitnessoutcomes Instagram account within two (2) business days of the draw.
The Promoter will publish the winner's first name and social media handle on the Promoter's and/or Alida Ballestro's relevant social media account from 25 September 2026, for a minimum of 30 days.
11. Social Media
This promotion is in no way sponsored, endorsed, administered by or associated with Instagram. Entrants acknowledge that they are providing their information to the Promoter and not to Instagram.
12. General
a) The Promoter reserves the right, at any time, to verify the validity of entries and entrants.
b) The Promoter may disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
c) The Promoter's decision is final and no correspondence will be entered into.
d) If for any reason the promotion is not capable of running as planned, the Promoter reserves the right to modify, suspend, terminate or cancel the promotion, subject to any applicable laws.
e) To the extent permitted by law, the Promoter accepts no responsibility for any loss, damage or injury suffered in connection with the promotion or any prize.
f) Nothing in these Terms and Conditions limits, excludes or modifies any consumer guarantee or other right which cannot be lawfully limited, excluded or modified.
13. Privacy
The Promoter collects personal information in order to conduct the promotion and may disclose such information to third parties, including prize suppliers and service providers, for the purpose of administering the promotion and delivering the prize.
