We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us.

We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

 

PLACING AN ORDER FOR PRODUCTS

You may order products by selecting and submitting your order through the Site in accordance with these terms and conditions. 

Any order placed through this Site for a product is an offer by you to purchase the particular product for the price notified (including the delivery and other charges and taxes) at the time you place the order. 

We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the Site. 

By placing an order, you agree to provide us with current, complete and accurate details when asked to do so by the Site. 

Please note: a mobile number is required for checkout (unless this is not possible) as this is where all communication will be automated too. In the event that a mobile is not provided, a landline will be accepted although live tracking of the delivery will not be feasible and responsibility to retrieve the delivery during the expected date and delivery window remains with the customers.

Delivery Dates & Order Cut Off Times

Fitness Outcomes reserves the right to change/alter delivery dates and order cut off times without any notice. Fitness Outcomes will do their best to notify customers of any changes.

We will aim to deliver during the date and window that you select. However, if an event occurs that is beyond our reasonable control, then we may not be able to do so, and will not be liable to you or any other person for any such delay. In this instance, we will endeavour to provide you with notice of such delay as soon as reasonably possible. 

Our standard procedure is to deliver the products to the front door at the relevant Delivery Address if we deem the premises safe and secure. Please ensure you are able to retrieve the delivery within a suitable amount of time as we will not be held liable for damages caused by goods being left unattended for extended periods of time. 

 

Order Cancellations

We may cancel any part of an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if:

1 The requested products in that order are not available; or

2 There is an error in the price or the product description posted on the Site in relation to the relevant product in that order; or

3 That order has been placed in breach of these terms and conditions. 

If we do so, then we will endeavour to provide you with reasonable notice of that cancellation, and will not charge you for the cancelled order if we cancel it before the delivery date or if you are not at fault or in breach of these terms and conditions.

Should you wish to cancel an order that has been placed, it must be cancelled prior to the order cut off time relevant to your region. Any orders which have been processed for delivery, will not be refunded. This applies to both single and recurring orders.

To cancel an order, email orders@fitnessoutcomes.com.au with your full name and order number.

Delivery of Goods

Goods will be delivered between 7:30am-6:30pm in Metropolitan areas and between 9am-6pm in regional areas. Business addresses will receive goods between 9am-4pm. 

Goods are delivered in insulated box's, keeping meals cool for up to 6-8 hours (This can vary on extremely hot summer days). Fitness Outcomes will not accept returns or refund requests for any meals/deliveries which have been delivered in good order.

Risk and Title

The title in the Products will pass to you from the time of delivery.

Returns & Refunds

Fitness Outcomes reserves the right to refuse returns or refunds for goods that have been received in good order, which have been opened, tampered with or deliberately soiled. Fitness Outcomes will not accept any return or refund requests for any meals incorrectly ordered by customers or delivered to incorrect addresses provided by the customer.

For any received goods which are incorrectly received, damaged or spoiled, please contact our team within 12 hours of delivery by emailing orders@fitnessoutcomes.com.au . Date stamped are required to investigate.

Date stamped images are required to lodge your replacement/refund request. Failure to provide images may result in a declined return/redelivery request.  All approved refund requests will be refunded within three (3) business days.

This refund policy does not apply to goods which have been opened, used or damaged after delivery, or if any attempt has been made to alter the product.  

SUBSTITUTION OR MISSING ITEMS IN DELIVERY

 You acknowledge that a product that you order may be out of stock or temporarily unavailable. If this happens, then we will not be able to provide you with that product.

If you select the substitute option for some or all of your products in an order, then we will endeavour to provide you with a substitute product:

1 When the product you have selected is not available; or

2 If we are not able to supply the product that you have selected to you.

We aim to select substitute products that are of similar value and quality, but we reserve the right not to provide you with a substitute product even if a suitable substitute product is available.

We provide you with an option to obtain a substitute product for most products.

If selected by you, then we will endeavour to provide you with a substitute product where the price for that substitute product is of equal or greater value than the product you selected. If so, then we will charge you the price of the product you ordered rather than the price of the substitute product.

If there are missing items from your delivery, then you should check the receipt that we provided to you to determine if the missing product is marked as out of stock. If so, then we:

 will provide you with a credit to your card of purchase for the products that were not supplied.

 In all other circumstances, you must contact us on (08) 9375 1566 during Office Hours within 24 hours of the delivery time and we will take steps to verify and confirm any such missing items. Once we are reasonably satisfied that the item was not delivered to you, then we will (at your option): (i) provide you with a credit to your relevant card account within 3-5 business days for the products that were charged but not delivered to you; or (ii) arrange for a re-delivery of the missing item at an agreed time.

Warranties and Disclaimers

To the maximum extent permitted by law, including the Australian Consumer Law, we make no warranties or representations about this website or the Content, including but not limited to warranties or representations that they will be complete, accurate or up-to-date, that access will be uninterrupted or error-free or free from viruses, or that this website will be secure.

We reserve the right to restrict, suspend or terminate without notice your access to this website, any Content, or any feature of this website at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Liability

To the maximum extent permitted by law, including the Australian Consumer Law, in no event shall we be liable for any direct and indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered due to your use of our website and/or the information or materials contained on it, or as a result of the inaccessibility of this website and/or the fact that certain information or materials contained on it are incorrect, incomplete or not up-to-date.

 Allergies

Fitness Outcomes clearly lists all product ingredients on each individual menu page, in addition all ingredients are clearly listed on product packaging. Should you (or whoever is eating our meals) suffers from an allergy, please check the ingredients listing before purchasing.

COUPON & VOUCHER USAGE

Coupons and vouchers are created to give value to and reward our customers. At times exclusive coupons will be issued to reward participants of partner programs and members of other organisations. If it is deemed that a coupon has been used outside of its intended issuing (at the sole discretion of Fitness Outcomes) we may ask for additional information to validate its use, or in some circumstances revoke its use.

GOVERNING LAW

Your use of the website and these Terms are governed by the law of Victoria and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria.
